Terms of service

These terms are an agreement between Infoveritas Technologies Pvt Ltd (“we”, “us”), a company incorporated in India, and the business that signs up for EkamOS (“you”). They are written in plain language. Our registered office address and corporate identity number are available on request at legal@ekamos.in.
1. Who these terms are for
EkamOS is for businesses: hotels and other stays, cafés and restaurants, coworking spaces, PGs and co-living, event venues and similar operations. It is not offered to consumers. The person accepting these terms confirms that they are authorised to do so for the business.
If you and we sign an order form or a quote, it forms part of this agreement. Where it conflicts with these terms, the order form wins.
2. The service
- EkamOS is a web app. Each of your locations runs the modules it needs, such as hotel front desk, café point of sale, coworking, PG and co-living, events, inventory, accounts and reports. Some modules are switched on by our team during setup.
- Features marked in the app or on our website as “Beta”, “Not live yet” or “Coming soon” are not part of the service until they are released. Beta features are provided as they are, may change, and may be withdrawn.
- Connections to other services, such as Razorpay, WhatsApp or Tally, depend on those services and on your own agreements with them. We are not responsible for a third-party service being unavailable or changing.
- We improve EkamOS continuously. We will not remove a core feature you are paying for without telling you in advance.
3. Accounts and access
- The account owner decides who on their team gets access, to which locations, and with which role, and is responsible for what those users do in the account.
- Keep passwords private, and turn on two-factor sign-in for anyone who can see money or identity documents.
- Tell us promptly at hello@ekamos.in if you think someone has accessed your account without permission.
4. Acceptable use
You agree not to:
- use EkamOS for anything unlawful, or to store personal data you have no lawful basis to hold;
- send marketing messages to people who have not consented to them;
- try to access another business’s data, test our security without our written permission, or disrupt the service;
- copy, resell or reverse engineer EkamOS, or use it to build a competing product.
If you find a security issue, please report it to us privately through the contact form on our website.
5. Fees and billing
- Fees, billing cycle and payment terms are as set out in your order form or invoice. Invoices include GST where it applies.
- If an invoice remains unpaid, we may suspend access after giving you 15 days’ written notice. Your data is not deleted because of a suspension.
- We may change prices for the next billing period by giving you at least 30 days’ notice.
- Except where your order form says otherwise or the law requires, fees already paid are not refundable.
6. Your data
- You own the data you put into EkamOS. You give us permission to process it only to provide, secure and support the service for you.
- For the personal data of your guests, tenants, members, visitors, employees and leads, you are the Data Fiduciary under the Digital Personal Data Protection Act, 2023, and we are your Data Processor. You are responsible for giving people notice, getting any consent you need, and deciding how long to keep their data. Our privacy policy sets out what we do as your processor. Business customers can request our data processing agreement at legal@ekamos.in.
- You can ask us for an export of your data at any time while you use EkamOS, and for 30 days after the agreement ends. After that we delete it from our live systems within 90 days, except where the law requires us to keep something. Copies in our encrypted backups expire on their normal cycle, within 12 months at the latest for monthly backups.
7. Tax, legal and compliance records
EkamOS helps you prepare GST invoices, keep a guest register, track Form C deadlines for foreign guests, record tenant police verification and handle data requests. It does not file anything with the authorities on your behalf. You remain responsible for the accuracy of what you enter, for your filings, and for meeting the laws that apply to your business. Nothing in EkamOS is tax or legal advice; please check with your chartered accountant or lawyer.
8. Availability and support
We work to keep EkamOS available and to back up your data every day, but we do not promise uninterrupted service unless a service level is agreed in your order form. We may need short maintenance windows, and we will try to schedule them outside business hours. Support is available by email at hello@ekamos.in, 10:00–19:00 IST, Monday to Saturday, excluding public holidays.
9. Intellectual property
We own EkamOS, including its software, design and content. While your subscription is active, you have the right to use it for your business under these terms. If you send us suggestions, we may use them without owing you anything.
10. Confidentiality
Each of us will keep the other’s non-public business information confidential and use it only for this agreement, except where the law requires disclosure.
11. Warranties
We will provide the service with reasonable skill and care. Apart from that, and to the extent the law allows, EkamOS is provided without other promises, including that it will be error-free or fit for a particular purpose.
12. Liability
- Neither of us is liable for indirect or consequential loss, such as lost profits or lost business.
- Our total liability under this agreement is limited to the fees you paid us in the 12 months before the event that caused the claim.
- These limits do not apply where the law does not allow them to.
You will compensate us for claims made against us by others because of data or content you put into EkamOS without the right to do so, or because of your breach of section 4.
13. Term and ending the agreement
- The agreement runs for the period in your order form and renews for the same period unless either of us gives at least 30 days’ notice before it ends.
- You can stop using EkamOS by giving us 30 days’ notice.
- We can end the agreement if you seriously breach these terms and do not fix the breach within 30 days of our notice, or straight away if you use the service unlawfully.
- When the agreement ends, section 6 explains what happens to your data. Sections that by their nature should continue, such as confidentiality and liability, continue.
14. Changes to these terms
We may update these terms. We will post the new version here and email account owners at least 30 days before a material change takes effect. If you do not agree, you can end the agreement before then.
15. Governing law and disputes
These terms are governed by the laws of India. The courts in the city of our registered office have exclusive jurisdiction over any dispute arising from them.
